Article 1 – Definitions

1.  Entrepreneur:  Fitstart Pharma, registered with the Chamber of Commerce under number 82260154.
2.  Consumer/Customer:  any natural person or legal entity that places an order with the entrepreneur.
3.  Products:  Peptides and laboratory products intended for research purposes and not for human consumption.
4.  Agreement:  any purchase agreement between the entrepreneur and the customer via the webshop.
5.  Website:  the webstore of Fitstart Pharma.

Article 2 – Applicability

These general terms and conditions apply to all offers, orders, agreements, and deliveries of Fitstart Pharma.

Article 3 – Products and use

1. The products are intended exclusively for research purposes.
2. The products are not suitable for human consumption.
3. By placing an order, the customer declares to handle the products responsibly and to use them in accordance with laws and regulations.
4. The entrepreneur is not liable for misuse of the products.

Article 4 – Offer and prices

1. All prices are stated in euros and include VAT, unless otherwise indicated.
2. Obvious errors or mistakes in the offer do not bind the entrepreneur.

Article 5 – Order and agreement

1. The agreement is formed after the customer places an order and receives a confirmation thereof.
2. The entrepreneur may refuse orders in case of suspected abuse.

Article 6 – Payment

Orders will only be processed after successful payment.

Article 7 – Delivery

Delivery times are indicative and not binding deadlines.

Article 8 – Right of withdrawal and return policy

1. Returns are not possible due to the nature of the products (health and laboratory products), in accordance with Article 6:230p of the Dutch Civil Code.
2. By placing an order, the customer agrees to the waiver of the right of withdrawal.

Article 9 – Complaints

Complaints must be submitted in writing within 7 days of discovery. The entrepreneur will respond within 14 days.

Article 10 – Liability

1. The entrepreneur is not liable for damage caused by improper use by the customer.
2. Liability is limited to the amount of the relevant order.

Article 11 – Force Majeure

In the event of force majeure, the entrepreneur is not obliged to compensate for damages.

Article 12 – Privacy

The entrepreneur processes personal data in accordance with applicable privacy legislation. The privacy statement is available on the website.

Article 13 – Applicable law

These terms and conditions are governed by law.
